By accessing or using lahnch (“Service”) at lahnch.com, you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Service Description

lahnch provides restaurant owners with tools to create, publish, and manage professional websites. Features include AI-assisted content management, menu updates via chat, Google Business Profile synchronization, and custom domain support.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must provide accurate information and keep it up to date. You must be at least 18 years old to use the Service.

4. Subscription and Payment

• The Service is available on a monthly subscription basis at the price listed on lahnch.com/pricing
• Payments are processed by Stripe and are due monthly in advance
• Subscriptions renew automatically unless cancelled before the renewal date
• We reserve the right to change pricing with 30 days' notice
• No refunds are provided for partial months except where required by law

5. Your Content

You retain ownership of content you upload (menus, photos, descriptions). By uploading content, you grant lahnch a limited license to host, display, and distribute that content solely to operate your restaurant website.

You are responsible for ensuring your content does not infringe third-party rights, violate applicable laws, or contain false or misleading information.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the platform or other users' accounts
• Upload malicious code, spam, or content that violates third-party rights
• Resell or sublicense the Service without written permission
• Misrepresent your identity or affiliation with any restaurant

7. Service Availability

We strive for high availability but do not guarantee uninterrupted service. We may perform scheduled maintenance with reasonable notice. We are not liable for downtime caused by third-party providers, force majeure, or events outside our reasonable control.

8. Termination

Either party may terminate the Service at any time. You may cancel your subscription through the dashboard. We may suspend or terminate your account for breach of these Terms, non-payment, or conduct that harms other users or the platform. Upon termination, your data is handled as described in our Privacy Policy.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR BE ERROR-FREE.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, LAHNCH SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to its conflict of law provisions. Disputes shall be resolved in the courts of Los Angeles County, CA.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or a notice on the Service at least 14 days before they take effect. Continued use after the effective date constitutes acceptance of the updated Terms.

2. 서비스 개요

lahnch는 음식점 사업주가 전문적인 웹사이트를 제작·게시·관리할 수 있는 도구를 제공합니다. AI 기반 콘텐츠 관리, 채팅을 통한 메뉴 업데이트, 구글 비즈니스 프로필 연동, 맞춤 도메인 지원 등의 기능을 포함합니다.

3. 계정 등록

서비스 이용을 위해 계정을 생성해야 합니다. 로그인 정보의 보안 유지와 계정 활동에 대한 책임은 이용자에게 있습니다. 정확한 정보를 제공하고 최신 상태로 유지해야 합니다. 만 18세 이상만 서비스를 이용할 수 있습니다.

4. 구독 및 결제

• 서비스는 lahnch.com/pricing에 명시된 가격으로 월 구독 방식으로 제공됩니다
• 결제는 Stripe를 통해 매월 선불로 처리됩니다
• 갱신일 전에 해지하지 않으면 자동으로 갱신됩니다
• 30일 전 사전 고지 후 요금을 변경할 수 있습니다
• 법률이 요구하는 경우를 제외하고 부분 월 환불은 제공되지 않습니다

5. 이용자 콘텐츠

업로드한 콘텐츠(메뉴, 사진, 설명 등)의 소유권은 이용자에게 있습니다. 콘텐츠를 업로드함으로써 lahnch에 해당 콘텐츠를 음식점 웹사이트 운영 목적으로 호스팅·표시·배포할 수 있는 제한적 사용 허가를 부여합니다.

콘텐츠가 제3자의 권리를 침해하지 않고, 관련 법률을 준수하며, 허위·오해의 소지가 없도록 이용자가 책임집니다.

6. 이용 제한

다음 행위를 금지합니다:

• 불법적인 목적의 서비스 이용
• 플랫폼 또는 다른 이용자 계정에 대한 무단 접근 시도
• 악성 코드, 스팸, 제3자 권리를 침해하는 콘텐츠 업로드
• 서면 허가 없이 서비스 재판매 또는 재라이선스
• 신원 또는 음식점과의 관계 허위 진술

7. 서비스 가용성

높은 가용성을 위해 노력하지만 무중단 서비스를 보장하지는 않습니다. 합리적인 사전 고지 후 정기 점검을 실시할 수 있습니다. 제3자 공급업체, 불가항력, 또는 합리적 통제 범위 밖의 사유로 인한 서비스 중단에 대해서는 책임지지 않습니다.

8. 서비스 해지

양 당사자는 언제든지 서비스를 해지할 수 있습니다. 대시보드에서 구독을 취소할 수 있습니다. 약관 위반, 미결제, 또는 타 이용자·플랫폼에 해가 되는 행위의 경우 계정이 정지 또는 해지될 수 있습니다. 해지 후 데이터는 개인정보 처리방침에 따라 처리됩니다.

9. 보증 부인

서비스는 상품성, 특정 목적 적합성, 비침해성에 관한 묵시적 보증을 포함하여 어떠한 보증도 없이 “있는 그대로” 제공됩니다. 서비스가 요구사항을 충족하거나 오류 없이 작동한다고 보장하지 않습니다.

10. 책임 제한

관련 법률이 허용하는 최대 범위 내에서, lahnch는 간접적·부수적·특별·결과적·징벌적 손해에 대해 책임지지 않습니다. 총 책임은 청구 직전 12개월간 납부하신 금액을 초과하지 않습니다.

11. 준거법

본 약관은 미국 캘리포니아주 법률의 적용을 받습니다. 분쟁은 캘리포니아주 로스앤젤레스 카운티 법원에서 해결합니다.

12. 약관 변경

약관은 수시로 업데이트될 수 있습니다. 중요한 변경사항은 시행 14일 전에 이메일 또는 서비스 내 공지를 통해 알려드립니다. 변경 후 지속적인 서비스 이용은 변경된 약관에 동의하는 것으로 간주됩니다.
